1. Acceptance of Terms

By accessing or using ToGathr, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the platform. We reserve the right to update these terms at any time with notice posted in the app.

2. Eligibility

You must be at least 18 years old to use ToGathr. By creating an account, you represent and warrant that you are 18 or older. ToGathr is not directed to, and we do not knowingly permit, anyone under 18. If we learn that an account belongs to someone under 18, we will terminate it. ToGathr is designed for social event discovery and in-person meetups among adults. Some events and curated experiences involve alcohol or are held at venues that require attendees to be 21 or older; these are marked accordingly, and by attending you represent that you meet the stated minimum age. You are responsible for complying with all age requirements and applicable laws, and the host or venue may verify your age at the door. Use of the platform for any purpose inconsistent with these Terms is prohibited.

3. Your Account

You are responsible for maintaining the security of your account and password. You are responsible for all activity that occurs under your account. Notify us immediately at legal@joingathr.app of any unauthorised use. You may not create multiple accounts, transfer your account to another person, or impersonate any other user. Session controls: From Settings, you may sign out of the current device or sign out of every active session on every device you have ever signed in from. Use the "Sign Out Everywhere" option if a device has been lost, sold, or used without your permission. It immediately revokes every session token associated with your account. Destructive actions: Certain destructive actions (deleting your account being the prime example) require you to re-prove your identity by entering your password in the confirmation dialog (or, for Google sign-in users, by relying on a freshly issued OAuth session). A valid session token alone is not sufficient. This is enforced server-side and is in place specifically to protect against a compromised or shared device.

3a. Organization Accounts

ToGathr supports Organization accounts for groups, community organizers, civic partners, and official ToGathr-operated accounts. If you create or join an Organization, the following additional terms apply: You may not create an Organization that impersonates another entity, misrepresents your affiliation, or uses a name or handle that is deceptive or misleading. Self-service creation: Any signed-in user may create their own Organization from /orgs/new. The form collects a public name, URL handle, optional tagline, optional description, optional city and state, and optional contact email. New Organizations are added at the community tier with a verification status of "pending"; the creator becomes the "owner". By creating an Organization, you represent that the information you provide is accurate, that the handle does not impersonate another entity, and that you are authorised to act on behalf of the group it represents (if any). ToGathr records an internal audit-log entry capturing who created the Organization and what fields they submitted; this entry is visible to that Organization's owners and admins, and may also be reviewed by ToGathr support staff when investigating a report. Organization owners are responsible for all activity posted under the Organization, including events, Updates feed posts (Section 11a), communities, and any content published by editors and admins they have granted access to. Only ToGathr may grant the "ToGathr Internal" tier to Organization accounts (e.g. official city operator accounts). Attempting to claim official ToGathr affiliation without this designation is a violation of these Terms. Verification: ToGathr reviews new Organization accounts and may approve, reject, or suspend them at its discretion. The Organization owner receives an in-app notification when a verification decision is made. Approval grants a verification badge and full posting rights. Rejection does not prevent you from re-applying after addressing the reason for rejection. Unverified, active Organizations can still post events and Updates, but Updates from unverified orgs are visible only to members of that org until the org is verified. If you are the sole owner of an Organization, you must transfer ownership to another member before deleting your personal account. Deleting your account removes your personal membership but does not automatically remove the Organization or its content. Posts you authored in an Organization's Updates feed are removed along with your account (database cascade); events and communities you posted under the Organization are preserved. Following Organizations: Any ToGathr user may follow an Organization to receive push notifications when it posts a new public event or a new Update (see Section 11a). Following does not create membership, grant access to private events or communities, or confer any moderation rights. You may unfollow at any time (ToGathr shows a confirmation dialog to prevent accidental unfollows). Organizations may not solicit follows through deceptive means or use follower notifications to send spam.

4. Acceptable Use

You agree not to use ToGathr to post illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content. You may not impersonate others, spam users, scrape data, or use the platform for any unlawful purpose. Violations may result in immediate account suspension or termination. We reserve the right to remove content and restrict accounts that violate these rules, including based on community safety reports.

5. People Matching, Waves & Paths Crossed

By enabling People Matching in Settings, you consent to your profile being surfaced to other attendees of the same events as a potential match. You can disable this at any time. Waves: ToGathr+ members may send a wave to a match before an event. By sending a wave, you acknowledge that if the recipient is a ToGathr+ subscriber, they will see your first name, profile photo, and interests you share with them. You agree to use waves in good faith as a genuine expression of interest in meeting someone at an event. Waves may not be used to harass, target, or intimidate other users. Attempting to use the wave system to identify or profile users beyond the disclosures described above is a violation of these Terms and may result in immediate account termination. You can withdraw a wave at any time by tapping the "Waved ✓" indicator on the event's match list, the incoming-wave row, or the Paths Crossed feed; this deletes the wave from our records and clears the mutual-wave signal, but does not retroactively erase any identity reveal that already occurred on the recipient's side. Paths Crossed: ToGathr+ members can access a feed of people they have co-attended events with, derived from check-in and RSVP records. By using ToGathr, you acknowledge that your attendance at public events (check-ins and RSVPs) may surface you in another ToGathr+ user's Paths Crossed feed if you share at least one event and have matching_enabled = true. You can prevent this by disabling People Matching in Settings → Privacy. Viewer presence: When two or more people are viewing an event whose start time is within 24 hours, the event page may display a "N viewing now" indicator. Only the deduplicated count is shown; individual viewer identities are never revealed. By using ToGathr, you acknowledge that your presence on an event page may be counted toward this indicator while you have the page open. Closing the tab removes you from the count.

6. Connection Requests

You may send a connection request to any user whose profile you can view. Each request is held as "pending" until the recipient accepts or declines it. Connection actions are subject to the following rules: Declining a request: When a user declines your connection request, you are not told that the request was declined. From your side, the UI may continue to show the request as pending. A 7-day cooldown then applies: during that window, any attempt to re-send a connection request to the same person will silently take no effect and will not generate a new notification for them. After 7 days, you may try again. At which point a fresh request can be delivered. This design protects users from being repeatedly contacted by people they have declined, while not exposing the fact of the decline. Withdrawing your own request: You may withdraw a pending request you sent at any time before it is accepted or declined. No retaliation: Attempts to circumvent the cooldown (for example by creating additional accounts, asking another user to relay messages, or otherwise pressuring a person who has declined) are violations of these Terms and grounds for account suspension or termination.

7. Post-Event Safety Reviews

After events, you may submit anonymous reviews of other attendees. By submitting a review, you represent that your responses reflect your honest, good-faith experience with that person at that event. You agree not to: • Submit false, misleading, or retaliatory reviews • Coordinate with others to inflate or damage another user's safety score • Use safety flags to harass or target users you have a personal dispute with Abuse of the review system (including false safety flags) is grounds for account suspension. ToGathr investigates all safety flags and retains the right to discount or remove reviews that appear to be in bad faith.

8. Safety Tiers & Account Restrictions

ToGathr calculates a safety tier (New, Verified, Trusted, or Flagged) based on aggregated community reviews. The Flagged tier is applied automatically when either: (a) any single reviewer submits a safety flag of type "threatening", or (b) at least two distinct reviewers have submitted a safety flag of any type against an account. While in the Flagged tier, an account is automatically excluded from pre-event match lists, Paths Crossed, and similar discovery surfaces. Designated members of the ToGathr team additionally review flagged accounts via an internal moderation tool to decide whether further action (warning, suspension, restriction of event hosting, or termination) is warranted, and may restore the tier if a flag was unfounded. We will notify you if a further action is taken against your account. Repeated or severe violations may result in permanent account termination. Moderator role: ToGathr administrators may grant trusted community members a moderation role, which gives access to the internal moderation queue. If you are granted this role, you will receive an in-app notification. Moderation access may be revoked at any time. As a moderator, you agree to handle flagged content confidentially and in good faith. Using access to the moderation tool to harass, expose, or target reported users is itself grounds for account termination. Platform moderation of events and communities: Separate from per-user safety actions, ToGathr platform admins (staff and trusted operators) may take direct action on individual events or communities that violate these Terms. The available actions are (a) hide the resource from public feeds and search (reversible — the author can still see it with a banner indicating why), or (b) permanently delete it (cascading related rows such as RSVPs, comments, posts, and chat messages). Editing your event's or community's title, description, or other fields is NOT a moderation action; platform admins cannot rewrite your content. Every moderation action requires the admin to enter a non-empty reason. The action type, target, reason, and metadata snapshot (event title or community name preserved at action time) are recorded in ToGathr's internal moderation_audit_log. This log is visible only to the platform-admin team and is retained indefinitely. The ToGathr-operated city organisations (gathr_internal tier) are managed directly by ToGathr staff through the normal management UI; that direct access is separate from the moderation flow described above and does not apply to user-created events or communities. Appeals: If a moderation action against your content was in error, contact safety@joingathr.app with the event or community ID and a brief description. Moderation decisions are reviewed by a different staff member than the one who took the original action wherever possible. Reposting hidden or deleted content to evade moderation is itself a violation and may escalate to account-level action.

9. ToGathr+ Subscription

ToGathr+ is the premium attendee tier of ToGathr. It unlocks: pre-RSVP match preview (see who's going before you RSVP), wave sender identity (ToGathr+ recipients see the first name, photo, and shared interests of who waved at them), unlimited waves, Paths Crossed history, priority matching rank, Open to Dating Mode, Travel Mode (coming soon), and a Founding Member badge for the first 1,000 paid subscribers. Pricing: ToGathr+ is available at $4.99/month or $39.99/year (Annual plan saves 33%). Paid billing will activate following completion of our payment processing setup. You will be notified before any charge is made. To be the first to know, join the early-access list at joingathr.app/waitlist. Founding Member badge: The first 1,000 paid ToGathr+ or Bundle subscribers receive a permanent "Founding Member" badge. This badge appears on your profile and as a ✦ symbol beside your name in search results, event attendee lists, community member lists, and event card host chips. It is granted once at subscription time, is non-transferable, and remains permanently even after a subscription lapses. Free 7-Day Trial: Eligible users (account at least 1 hour old, no prior trial used) may claim a one-time 7-day ToGathr+ free trial. No card is required. Access ends automatically when the 7 days expire. The trial may only be claimed once per account; enforced server-side and cannot be bypassed. Level-Milestone Previews: Reaching level 5 grants a one-time 48-hour ToGathr+ preview; reaching level 10 grants a one-time 7-day preview. These are automatic, non-repeatable rewards, not a paid free trial. They do not renew, cannot be transferred, and expire at the time shown in your profile. Open to Dating Mode: ToGathr+ subscribers may opt in to Open to Dating Mode in Settings to signal openness to romantic connections. This status is disclosed only to other active ToGathr+ subscribers who have also opted in. It appears in the Paths Crossed feed and pre-event match lists between mutually opted-in members. Turning Open to Dating Mode ON requires an active ToGathr+ subscription. Turning it OFF does not — if your ToGathr+ subscription has expired or been cancelled while you were opted in, you can still opt out from Settings at any time without re-subscribing, and the server will require you to confirm the change in a bottom-sheet prompt before saving. Toggles in either direction are rate-limited (5 per 24 hours per account) to prevent abuse. By enabling Open to Dating Mode, you acknowledge that other opted-in ToGathr+ members will see that you have indicated openness to romantic connection. Use of this feature to harass, misrepresent your intentions, or pressure other users is a violation of these Terms and grounds for account termination. Cancellation & Refunds: You may cancel ToGathr+ at any time and your subscription will remain active until the end of the current billing period. No partial refunds will be issued for unused time. Refund requests may be submitted to support@joingathr.app within 48 hours of a charge and will be handled on a case-by-case basis. If you delete your account, any active subscription is cancelled immediately with our payment processor, and your customer record at that processor is also deleted at the same time. You will not be charged again, and your PII at the payment processor is scrubbed (historical charges that we are legally required to retain remain only in aggregate form). Feature changes: We may add, modify, or remove ToGathr+ features at any time. Material reductions in features will be communicated in advance.

9a. Host Pro & Bundle Subscriptions

Host Pro is the paid host tier of ToGathr. It unlocks deep analytics (monthly RSVP trends, check-in conversion, fill-rate history), attendee CSV export, 5 feature credits per month (used to feature your own events at the top of the home feed; unused monthly credits expire at month-end and do not roll over), custom RSVP questions, co-host invites, and a Founding Host badge for the first 500 subscribers. Bundle: ToGathr offers a combined "ToGathr+ & Host Pro" bundle for members who want both attendee and host features in a single subscription. Pricing: Host Pro is available at $9.99/month or $79.99/year. The Bundle is available at $12.99/month or $99.99/year. Both plans follow the same billing timeline as ToGathr+. Payments will activate following completion of our payment processing setup. Join the early-access list at joingathr.app/waitlist to be notified first. Founding Host badge: The first 500 paid Host Pro or Bundle subscribers receive a permanent "Founding Host" badge. This badge appears on your profile and as a ✦ symbol beside your name in search results, event attendee lists, community member lists, and event card host chips. Cancellation & Refunds: You may cancel Host Pro or Bundle at any time and your subscription remains active until the end of the current billing period. No partial refunds will be issued for unused time. Refund requests may be submitted to support@joingathr.app within 48 hours of a charge and will be handled on a case-by-case basis. Account deletion cancels any active subscription and deletes your customer record at our payment processor. You will not be charged again. Organization tiers: Organizations on ToGathr (civic, partner, and community tiers) receive Host Pro equivalent features as part of their organization account. These features are provisioned by ToGathr and are separate from the individual Host Pro subscription described here.

9b. Referrals

ToGathr may offer a referral program that rewards you when someone you invite joins ToGathr and meets the stated qualifying conditions (for example, signing up with your link and attending their first event). Rewards — such as ToGathr+ time — have no cash value, are non-transferable, cannot be exchanged for money, and may be granted, withheld, modified, or revoked at our discretion. You may not abuse the program, including by creating fake or duplicate accounts, self-referring, or using bots or automated means; doing so is a violation of these Terms and may result in forfeiture of rewards and account action. We may change or end the referral program at any time.

10. Events & RSVPs

ToGathr is a platform for discovering and organising events. We are not responsible for the content, safety, or conduct of any event listed on the platform. Event hosts are solely responsible for ensuring their events comply with applicable laws and regulations. Attending any event found through ToGathr is at your own risk. Ticket Types: When creating an event, hosts may designate it as Free, Paid, or Donation-based. Paid and Donation events display the specified price or suggested amount on the event card. Paid ticket prices must be a positive value, may not exceed $10,000 per ticket, and may not contain more than two decimal places. These constraints are enforced by the platform at the time of event creation. Paid Ticket Payment Processing (Coming Soon): In-app payment collection for paid events is not yet active. Tapping "Get Ticket" on a paid event will display a notice explaining that ticketing is coming soon and directing you to our waitlist. Until in-app payments are live, hosts are solely responsible for collecting any fees through their own means. ToGathr does not process or facilitate payments during this period. Misrepresenting ticket pricing or collecting fees without delivering the advertised event is a violation of these Terms. Custom RSVP Questions: Hosts with Host Pro (and organization editors+) may attach up to five short questions to an event. When you RSVP to such an event, the form will ask you to answer those questions before your RSVP is confirmed. By submitting an RSVP with answers, you (a) consent to the host (and any org editor+ for an organization-posted event) viewing your responses, and (b) agree that your answers reflect your honest, good-faith information at the time of submission. Submitting deliberately false or misleading answers to bypass host vetting is a violation of these Terms. Hosts may not require disclosure of information that would itself violate applicable law (for example, demanding medical diagnoses or other protected-class information as a precondition to attendance). Post-Event Feedback: After an event ends, you may submit one event-level rating (1–5 stars) and an optional comment to the host. This is separate from the peer-to-peer safety reviews described in Section 7. Feedback is visible only to the event host and any org editor+ for the event's organization; non-hosts see only an aggregate average. You may edit your own feedback within 24 hours of submission. By submitting feedback, you agree it reflects your honest impression of the event itself, not retaliation against the host or any other attendee. Event Templates: Hosts may save the reusable slice of an event setup (title, category, description, venue name, venue street address, map coordinates, city, capacity, ticket type, tags, privacy) as a template for future events. Templates do not save date, time, or cover image. Templates are private to the creator and (when saved while posting as an organization) to that organization's owners, admins, and editors. Using a template to mass-spawn near-duplicate events or to evade content moderation is a violation of these Terms. Private Community Join Requests: Some communities are set to private and require owner or admin approval before a member can participate. When you submit a join request, it is held as pending until approved or declined. If approved, you receive an in-app notification and are immediately added as a member. If declined, the pending row is deleted. You are not explicitly notified of a decline. You may re-apply at any time. RSVP Cancellation: You may cancel your RSVP to any event at any time before the event starts. Cancellation releases your spot back to the event. The platform will ask you to confirm before cancelling to prevent accidental removals. Cancelling an RSVP also deletes any answers you submitted to the event's custom RSVP questions. Co-Host Invites: Event hosts with an active Host Pro subscription may invite another ToGathr user as a co-host. (Hosts without Host Pro see an upsell on the event edit page instead of the invite form; existing co-host relationships established under a previous subscription remain functional if the host's subscription lapses.) By accepting a co-host invite, you agree to act in good faith on behalf of the original host: editing the event responsibly, managing the street address and custom RSVP questions accurately, and not using your access to harvest attendee data or contact attendees outside ToGathr's direct-message system. Accepted co-hosts have the same edit rights as the original host EXCEPT they cannot delete the event, change the original host, or invite further co-hosts. These restrictions are enforced server-side. Either the original host or the co-host may revoke the co-host role at any time. Inviting a co-host you do not have a real relationship with, or accepting an invite for an event you have no intention of helping run, is a violation of these Terms and grounds for action against both accounts. RSVP Visibility: When you RSVP to an event, you can control who sees your attendance in the attendee list: public (anyone viewing the event), connections-only (only users you are connected with), or private (only visible to yourself and the event host). You can set this preference in Settings → Privacy. Note that regardless of your visibility setting, the event host can always see that you RSVPed and can see your visibility setting itself — this is so hosts can identify which attendees have opted for private or connections-only visibility on the attendees management page. Your visibility setting does not affect the host's ability to manage the event, contact you through ToGathr's direct-message system, or see your check-in status. Check-In: After RSVPing, you may tap "I'm Here" during the event window (30 minutes before start through end time) to record your attendance. ToGathr may request your device's GPS location at that point. If granted, your coordinates and distance from the venue are stored and displayed in miles; attendees within approximately 0.3 miles (500 metres) of the venue are recorded as `geo_verified` check-ins. Attendees further from the venue, or attendees who deny location access entirely, can still complete a `self_attested` check-in via a soft confirmation prompt. ToGathr distinguishes the two verification levels internally and may use the distinction to weight features such as post-event matches. Check-in data is visible to the event host for attendance analytics. Checking in is required to access the post-event survey. For match reveals, free users need both an RSVP and a check-in; ToGathr+ subscribers access match previews without checking in. If you check in by mistake, you may undo your check-in within 10 minutes of recording it; after that window the check-in is final for that event.

10a. In-Person Meetups, Curated Experiences & Assumption of Risk

Many events on ToGathr are created by independent users and organizations. For those events, ToGathr is a discovery platform only — we are not a party to, and do not organize, supervise, or control, the event, and the host is solely responsible for it. Curated Experiences are different: at this time they are organized by ToGathr through our official city accounts (in the future, curated experiences may also be hosted by partner organizations or businesses, who would then be the host shown). We select the format and venue and arrange the small-group seating. However, organizing an experience does not mean we supervise attendees' conduct or guarantee anyone's safety. We do not perform background checks or identity verification on attendees, and you remain responsible for your own safety and decisions. You attend all in-person events and curated experiences at your own risk. Meeting people you do not know carries inherent risks. You agree to exercise your own judgment — for example, telling someone you trust where you are going, arranging your own transportation, and leaving any situation that feels unsafe. Safety tiers are not a safety guarantee. The New, Verified, Trusted, and Flagged tiers reflect aggregated, anonymous peer feedback from other members only. They are not identity verification, criminal-background checks, or any assurance that a person is safe to meet. A higher tier does not mean ToGathr has vetted or endorsed that person. Do not rely on a safety tier as a substitute for your own caution. Curated Experiences specifics. Curated Experiences are small, hand-picked gatherings. To protect attendees, the exact venue is withheld until shortly before the event and is shown only to confirmed guests; an area, price range, date, and format are shown beforehand. Eligibility to register may require a complete profile (such as a photo and name) and/or a minimum safety tier, and some experiences require an active ToGathr+ subscription. Registering reserves a seat; if an experience is full you may be placed on a waitlist. You may cancel your registration from the experience page. Because seats are limited and tables are small, cancellations close to the event affect other guests — we ask that you cancel as early as possible, and repeated no-shows or last-minute cancellations may affect your eligibility for future curated experiences. ToGathr may cancel, reschedule, or change a curated experience, including if a minimum number of guests is not reached. To the maximum extent permitted by law, and except where such limitation is prohibited, you agree that ToGathr's role in organizing a curated experience does not make us liable for the conduct of any attendee or third party, for incidents that occur during or after a meetup, or for your reliance on safety tiers or member-provided information. This is in addition to Sections 15 and 16.

11. User Content

You retain ownership of content you post on ToGathr (photos, event descriptions, community posts, comments, reviews, chat messages, etc.). By posting content, you grant ToGathr a non-exclusive, royalty-free licence to display and distribute that content within the platform. You represent that you have the rights to any content you post and that it does not violate any third-party rights. Image Uploads: You may upload images to your profile, event covers, community banners, community posts, and chat conversations. Uploaded images must not contain nudity, illegal content, graphic violence, or content that violates any applicable law. We enforce file type, size, and content-signature (magic byte) limits server-side; renaming a non-image file to a permitted extension does not bypass validation. Chat attachments are private: Photos, PDFs, and other files sent in 1:1 conversations are stored in a private bucket and served only via authenticated, short-lived signed URLs. They are not accessible at a guessable public address and only the two participants of the conversation can view them. Profile photos, event covers, community banners, community post images, and organization logos and banners remain on public buckets and are visible to other ToGathr users. Organization logos and banners: If you are an owner or admin of an Organization, you may upload a logo and banner image. These are stored in a public bucket and visible to all ToGathr users who view the organization profile. The same content rules apply: no nudity, illegal content, graphic violence, or branding that misrepresents your organization's identity. You represent that you have the rights to any image you upload. Offline messages: Messages composed while your device is offline are saved to your browser's local storage (IndexedDB) and sent automatically once connectivity returns. Until the message reaches ToGathr's servers, it is your responsibility and lives only on your device. We make a reasonable effort to flush the outbox on reconnection but cannot guarantee delivery of a message that fails to send (for example, if the recipient blocks you, or if the message violates rate limits at the time of flush). Community Events: Only community owners and admins may create new events linked to a community or link an existing event to it. By hosting an event, you agree to allow a community owner or admin (in any community you are a member of) to associate your event with that community. This association does not transfer ownership of your event and does not affect its visibility settings. Community Ownership & Transfer: A community has a single owner. The owner may transfer ownership to another member or admin of that community. A transfer is offered as a pending request: the proposed new owner receives an in-app notification and must explicitly accept it before ownership changes hands. The current owner may cancel a pending offer, and the recipient may decline it. When a transfer is accepted, the previous owner is automatically demoted to admin (they are not removed from the community). Ownership-changing actions are enforced server-side, and only the current owner may initiate a transfer. You may not use the transfer flow to hand a community to an account you know to be a duplicate, a bot, or a person acting in bad faith. Organization-Owned Communities: An owner or admin of an Organization may create a community on behalf of that Organization. A community attributed to an Organization is managed by that Organization's owners and admins in addition to the community's own owner, and the Organization is responsible for that community's content under Section 3a. Attribution does not change the community's members or its visibility settings. Content Removal: We reserve the right to remove any content that violates these Terms without notice. Community owners and admins may remove posts and messages within their communities.

11a. Organization Updates Feed

Organizations have a public "Updates" tab on their profile where owners, admins, and editors may post short text updates (up to 2,000 characters) with an optional link URL and an optional image. By using this feature you agree to the following: Author identity is pinned at insert time. The user who posted a given Update is recorded server-side and cannot be reassigned to a teammate. Editing a post does not change its author. Followers are notified. When an Update is posted, ToGathr sends a one-time in-app notification to every follower of that Organization other than the author. Owners are responsible for ensuring the Update content complies with these Terms (Section 4, Acceptable Use). Using Updates to send spam, promotional content unrelated to the Organization's stated purpose, harassing material, or links to third-party sites that violate any law is grounds for content removal and may lead to suspension of the Organization. Editing and deletion. The author of an Update may edit or delete it at any time. Org owners and admins may also edit or delete any Update in their Organization (including Updates authored by editors). Deletion is permanent; the post row and any attached image are removed. Links and images. Links must use http:// or https://. ToGathr does not control the destinations of these links and is not responsible for content hosted there. Images attached to Updates are subject to the same content rules as other image uploads (Section 11) and are stored in the public Organization assets bucket; they are visible to anyone who can view the Update. Visibility. Updates posted by verified, active Organizations are publicly readable to all signed-in ToGathr users. Updates posted by unverified or inactive Organizations are visible only to members of that Organization until verification is granted.

12. Privacy

Your use of ToGathr is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information, including the anonymity protections for waves and safety reviews.

13. Automated Decisions & AI

ToGathr does not use artificial intelligence, large language models, or machine learning to make decisions about you or your account. Match suggestions, event recommendations, safety tiers, and search results are produced by deterministic, hand-written code, not AI scoring. The search bar accepts natural-language phrases (e.g. "live music thursday night") that are interpreted by a fixed keyword parser, marked "Quick filters" in the UI; no LLM is in the loop and your queries are not sent to any third-party AI provider. Your messages, posts, photos, and profile content are not analysed by AI of any kind. If we ever introduce AI-assisted features (for example, optional content moderation), we will update these Terms and the Privacy Policy and give you the choice to opt out where applicable.

14. Intellectual Property

The ToGathr name, logo, and platform design are owned by ToGathr and may not be used without permission. All rights not expressly granted in these Terms are reserved.

15. Disclaimers

ToGathr is provided "as is" without warranties of any kind. We do not guarantee that the platform will be uninterrupted, error-free, or that defects will be corrected. Safety tier scores reflect aggregated, anonymous community feedback only. They are not identity verification, criminal-background checks, or an endorsement or guarantee of any individual's conduct or safety. You should not rely on a safety tier as assurance that any person is safe to meet. We are not liable for any damages arising from your use of the platform or from attending any event found through it.

16. Limitation of Liability

To the maximum extent permitted by law, ToGathr shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, including damages arising from reliance on safety tier information, wave interactions, or event attendance.

17. Termination

We may suspend or terminate your account at any time for violation of these Terms, including for abuse of the safety review system, wave system, or repeated safety flags from other community members. You may delete your account at any time through Settings → Danger Zone. The dialog will ask you to type the word "DELETE" to confirm. For email-and-password accounts, you must also re-enter your password. Both safeguards are enforced server-side: a borrowed or stolen session token alone is not enough to destroy the account. Google sign-in users rely on the freshly issued OAuth session instead of a password. Once you confirm, your profile, RSVPs, connections, messages, community memberships, and ToGathr+ status are permanently removed within 30 days. Events you have hosted are preserved. Your name is removed as host so that attendees are not left without context. If you wish to remove your hosted events entirely, please delete them from the event management page before deleting your account. Any active ToGathr+ subscription is cancelled with our payment processor at the moment of deletion, and your customer record at that processor (which holds personally identifying details such as email address and partial card information) is also deleted at the same time. You will not be billed again and your PII at the payment processor is scrubbed. The processor retains only the historical charge records that we are legally required to keep for refunds, disputes, and tax purposes; those records do not contain enough information to re-identify you. Anonymised review data you submitted may be retained to preserve the integrity of other users' safety scores. Upon termination, your right to use ToGathr ceases immediately.

18. Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles.
